Terms and Conditions of Sale

1. Purpose and Scope

These Terms and Conditions of Sale (the "Terms") govern the sale of tickets by ETICKETSY LLC, whose principal office is located at 9348 Civic Center Dr, Beverly Hills, CA 90210, United States. By using the website eticketsy.com and placing an order, you agree to be bound by these Terms.

Eticketsy is an independent resale marketplace. ETICKETSY LLC is not affiliated with, endorsed by, or acting on behalf of any venue, artist, team, promoter, or primary ticketing company (such as Ticketek or Ticketmaster). Tickets offered on eticketsy.com are resold and their prices are set by market demand: they may be higher than the face value printed on the ticket. The total price shown before you pay includes GST and all service and delivery fees. Our goods and services come with guarantees that cannot be excluded under the Consumer Guarantees Act 1993. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred on you by the Consumer Guarantees Act 1993, the Fair Trading Act 1986 or any other applicable law that cannot be excluded, restricted or modified by agreement.

2. Products and Services

2.1 Tickets Offered

ETICKETSY LLC offers tickets for concerts, sporting events, and shows in New Zealand and abroad.

2.2 E-ticket Features

Tickets are delivered electronically (e-tickets) and carry a unique QR code. They are available at any time from your customer account on eticketsy.com and can be added to Apple Wallet or Google Wallet.

2.3 Availability and Order Limits

Tickets are offered subject to availability. ETICKETSY LLC reserves the right to limit the number of tickets per order.

3. Ordering

3.1 Order Process

Orders are placed exclusively online at eticketsy.com. You select the tickets you want, enter your contact details, and complete secure payment.

3.2 Order Confirmation

Your order is confirmed once payment has been made and accepted by our payment system.

3.3 Email Confirmation

An order confirmation is sent by email to the address you provided.

4. Prices and Payment

4.1 Prices in New Zealand Dollars

Ticket prices are displayed in New Zealand dollars (NZD) and include GST (15%) where applicable. The total price shown before payment includes all service fees and delivery fees. No additional mandatory fees are added at checkout.

4.2 Accepted Payment Methods

Payment is made by credit or debit card through our secure payment provider, Stripe.

4.3 Payment Security

ETICKETSY LLC uses industry-standard technologies to secure transactions made on its website.

4.4 Tax Invoice

A receipt is issued and sent by email once your order is confirmed. A tax invoice is available from your customer account.

5. Ticket Delivery

5.1 Delivery by Email

E-tickets are sent by email to the address you provided.

5.2 Timing

Tickets are delivered by email immediately after your order is confirmed.

5.3 Ticket Format

Tickets are provided in PDF format and include a unique QR code.

6. Change of Mind

New Zealand law does not give you a general right to cancel an order for event tickets simply because you change your mind. Outside of (a) your rights under the Consumer Guarantees Act 1993 and the Fair Trading Act 1986, (b) cancellation of the event by the organiser (Section 8), and (c) the voluntary cancellation option described in our Cancellation Policy, no refund or exchange is available.

7. Guarantees

7.1 Ticket Authenticity

ETICKETSY LLC guarantees that the tickets it sells are 100% authentic and valid for entry.

7.2 Seats Together

For orders of multiple tickets, seats together are guaranteed.

7.3 Remedies

If you experience any problem with your order, please contact customer service so that we can find a solution. Where a ticket is not as described or not valid for entry, you are entitled to the remedies provided by the Consumer Guarantees Act 1993, including a refund or replacement.

8. Event Cancellation and Postponement

8.1 Refund upon Cancellation

If the event is cancelled by the organiser, your tickets will be refunded in full.

8.2 Validity upon Postponement

If the event is postponed, your tickets remain valid for the new date.

9. Cancellation Insurance

An optional cancellation insurance (Allianz) may be added to your order at checkout for a fee shown in New Zealand dollars. Its terms, covered events and claim procedure are stated during checkout and in your account. The insurance fee is non-refundable once the policy is issued. 10. Liability

10.1 Limitation of Liability

Subject to the Consumer Guarantees Act 1993 and to the extent permitted by law, ETICKETSY LLC shall not be liable for any indirect, incidental, special, or consequential loss arising from the purchase of tickets, and its total liability shall not exceed the amount you paid for the order concerned. If you acquire tickets for the purposes of a business, the Consumer Guarantees Act 1993 does not apply.

10.2 Force Majeure

ETICKETSY LLC shall not be liable for any failure to perform its obligations caused by events beyond its reasonable control.

Any dispute that cannot be resolved amicably may be brought before the courts of New Zealand or the Disputes Tribunal. Nothing in these Terms limits any non-excludable right you have under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986.
